Prospect Privacy Notice
Prospect is committed to protecting your privacy and complying with our obligations under the UK General Data Protection Regulations (UK GDPR), Data Protection Act 2018 and the Protection of Electronic Communications Act 2003, when you use our services.

- Key Terms
For information the following data protection definitions apply.
Personal Data: means any information relating to an identifiable natural living person (data subject); an identifiable natural person is one who can be identified, directly or indirectly by the information. This could be your name and contact details but can also include other things that when put together can also identify you such as documents, emails, photographs, audio recordings.
Special Category Data: Some information might be classed as ‘special category’, which because of its sensitivity needs more protection. The types of data that falls under this category are:

Criminal Data: Separate rules apply to data covering criminal allegations, proceedings, or convictions.
Processing: means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
Controller: means the natural or legal person, public authority, agency or other body which alone or jointly with others, determines the purposes and means of the processing of personal data.
Processor: a natural or legal person, public authority, agency or other body which processes personal data on behalf of the Controller.
Third Party: means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
Profiling: Any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
Consent: any freely given, specific, informed and unambiguous indication of the Data Subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

How we obtain your personal data.
Information you give us
In order to engage with non-member or to provide a service to you as a member we will collect information directly from you when you visit our websites www.prospect.org.uk and www.bectu.org.uk, when you contact us in writing, speak to us on the phone, by email or any other type of electronic communication, or talk to us face to face.
Information we collect from third parties
In some circumstances we may collect information from third parties, including: your employer, branch reps, training providers, lawyers.
Why do we need this information?
We may need to use your personal data for the following reasons:
- To meet our obligations as set out in the union rule book.
- To deliver and manage services to members.
- To provide advice and assistance to members.
- To provide legal assistance when appropriate.
- To conduct elections and ballots.
- To provide training opportunities for members and non-members.
- To communicate with members including providing information about campaigns, benefits, and services.
- To manage our website, and social media platforms.
- To manage staff who deliver those services.

How do we get information
- Personal information we process is provided directly when you:
- Join the union as a member.
- Request advice and assistance from the union up to and including legal assistance

We process information when it is provided indirectly:
- Your information is contained in documents/communications provided by members or employers during a workplace grievance/disciplinary/dismissal/ redundancy process.
- Information is provided by employers during employment related negotiations and procedures.
- Information is provided by other public bodies and organisations.
- Where you have made contact information available on your website and we use this to contact you or your organisation in our role as a trade union.
- A complainant refers to you in their complaint correspondence.
Data Sharing
We do not share any personal data with third parties for the purposes of direct marketing.
We will have data processing contracts in place when we use third parties for data processing. This means they cannot do anything with your personal data unless they are instructed to do so by us.
We use a range of organisations to deliver our services, and we may share your personal data. Where we do so we have agreements in place to make sure that they comply with data protection law.
In some circumstances we are legally obliged to share information, for example when involved in statutory recognition proceedings. We might also share information with regulatory bodies if required to do so by law.
When it is necessary to transfer your personal information outside the UK this will only be done in line with data protection regulations.
